The Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore Was Held in Geneva

The 45th Session of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (WIPO/GRTKF/IC/45) was held from 5 to 9 December 2022 in Geneva, Switzerland, in hybrid format.

The working agenda of GRTKF/IC/45 covered aspects related to:

  • Panel of Indigenous Peoples and Local Communities;
  • Operation of the Voluntary Fund for Accredited Indigenous Peoples and Local Communities;
  • Reporting on the Ad Hoc Expert Group on Traditional Knowledge and Traditional Cultural Expressions held on 4 December 2022.

During the Session, a range of documents were reviewed that address traditional knowledge and traditional cultural expressions including: rights/measures -based approaches, the relationship between national and international instruments, the differences between minimum and maximum standards and options for the legal nature of international legal documents. The Committee developed new texts on the protection of traditional knowledge and the protection of traditional cultural expressions - draft articles.

The Committee requested for the 46th Session that the texts be updated according to the proposals received during the session.

Later, on December 12-14, 2022, the meeting of the Working Group on the Legal Development of the Hague System for the International Registration of Industrial Designs in hybrid mode took place (H/LD/WG/11).

The topics that were discussed during the session:

  • Considerations Relating to the Possible Introduction of Continued Processing of an International Application. The International Bureau is to prepare updated documents with the proposals that were presented during the session.
  • Update on the Situation of the 1960 Act. It was decided to “freeze” its use and focus on the 1999 Act of the Hague System.
  • Study Report on the Availability and Usability of Translation Technologies in the Hague System.

During the sessions, the State Agency on Intellectual Property (AGEPI) was represented by Elena Dadu, Head of the Legal Assistance and Contract Registration Division and Lilia Vermeiuc, Principal Consultant, Industrial Designs Division.
