The State Agency on Intellectual Property (AGEPI) informs that in the Official Gazette of the Republic of Moldova No. 82-84 (8588-8590) of March 10, 2023, were published:

- Decision No. 2/333 of March 6, 2023, by which the Public Association “AUTORITY” was approved as a collective management organization for the management of copyright in musical and audiovisual works.

- Decision No. 3/334 of March 6, 2023, by which the Public Association “ARTTON” was approved as a collective management organization for the management of related rights in performances, phonograms and videograms.

According to Article 99 paragraph (1) of Law No. 230/2022, the remunerations due to authors and rightholders, as well as the conditions for collection and payment, shall be determined by collective management organizations and users within the negotiated methodologies.

It should be noted that the prerogative to develop a methodology and initiate negotiation procedures belongs to the collective management organization, users or their representative associations, with the fulfillment of the conditions provided by Article 99 paragraph (5) of Law No. 230/2022.

In this context, AGEPI urges both the approved collective management organizations and the users to be actively involved in the methodology negotiation procedure, in accordance with the provisions of Articles 99-101 of Law No. 230/2022.
