The State Agency on Intellectual Property (AGEPI) issued the industrial design (ID) registration certificate with the number 2 000. By filing the application to AGEPI, the designer Mihail Stamati requested the protection of the external appearance of a teapot. The ID registration certificate was presented to the owner by Eugeniu Rusu, Director General of AGEPI.
We should note that industrial designs represent the external appearance of a product or part of it rendered in two or three dimensions, resulting from the combination of the main characteristics, especially lines, contours, colors, shape, texture and/or materials of the product itself and/or its ornamentation. While the industrial design has a flat, 2D representation, the representation of the industrial model is three-dimensional.
It is important to underline the fact that the registration of industrial designs has as its object the protection of the external form of a commercial product, without having anything to do with its technical aspects.
The registered ID gives the owner the exclusive right to use it and to prohibit any third party from using it without the owner’s consent. Use means, in particular, the manufacture, inclusion in an offer, placing on the market, import, export or actual use of a product in which it has been integrated or to which the industrial design in question has been applied, as well as storage of the respective product for the aforementioned purposes.
