On May 21, 2026, the authorities responsible for the enforcement of intellectual property rights in the Republic of Moldova signed the Interinstitutional Order on the activity of the Observatory on Enforcement of Intellectual Property Rights and the Order on the approval of the Action Plan for Intellectual Property Rights Enforcement in the Republic of Moldova.

The documents were agreed and signed by the leaders of the public authorities responsible for the enforcement of intellectual property rights in the Republic of Moldova, namely: the State Agency on Intellectual Property, the General Police Inspectorate, the Customs Service, the General Prosecutorțs Office, the Agency for Digitalization in Justice and Court Administration, the State Inspectorate for Supervision of Non-Food Products and Consumer Protection, the Competition Council and the National Food Safety Agency.

By signing the Interinstitutional Order on the activity of the Observatory on Enforcement of Intellectual Property Rights, the National Food Safety Agency has acquired the status of permanent member of the Observatory. The expansion of the Observatory’s membership aims to strengthen interinstitutional cooperation and ensure a broader multi-sectoral representation in the field of intellectual property rights enforcement. At the same time, the Order approved the Regulation on the organization and functioning of the Observatory, which establishes the structure, powers, rights and the way of organizing its activity.

A significant progress in strengthening the national framework for enforcement of intellectual property rights is the approval of the Action Plan for Intellectual Property Rights Enforcement in the Republic of Moldova for 2026–2029, developed with the support of experts from the European Union-funded cooperation project in the field of intellectual property (EU4IP).

The document establishes the strategic directions and institutional measures necessary to strengthen the mechanisms for preventing and combating infringements of intellectual property rights, developing interinstitutional cooperation and streamlining the application of legislation in the field. At the same time, the Action Plan is correlated with national priorities and international commitments undertaken by the Republic of Moldova, including with the standards and good practices of the European Union. Its implementation aims to strengthen the capacities of the competent authorities in combating counterfeiting and piracy, stimulating innovation and a fair competitive environment, as well as increasing the level of consumer protection and economic security of the Republic of Moldova.

The respective actions arise from the priorities included in Annex B of Chapter 7 “Intellectual Property Law”, Cluster 2 “Internal Market” of the National Program for the Accession of the Republic of Moldova to the European Union for 2025-2029, approved by Government Decision No 306/2025.

The Observatory on Enforcement of Intellectual Property Rights has been active within AGEPI since 2011. The purpose of its creation was to ensure the exchange of information between the authorities responsible for monitoring the enforcement of intellectual property rights, as well as the development of reports, analytical and statistical studies in the field. At the same time, the Observatory exercises the functions of the Notification Center of the World Trade Organization for the implementation of the TRIPs Agreement and constitutes an efficient means of promoting the activities carried out by various authorities and institutions involved in combating the infringement of intellectual property rights.
