In order to exchange experience in the field of information technology, applied in intellectual property offices, and of protection of industrial designs, from 19 to 23 November 2012 in Chisinau will be a delegation of the State Office for Inventions and Trademarks of Romania (OSIM).
The working visit of the delegation of Romania provides a meeting with the AGEPI Management and two seminars - in the field of information technology and protection of industrial designs. The works of the first seminar will focus on topics such as:
- IT system of OSIM under the Cooperation Fund Programme coordinated by OHIM,
- AGEPI: Computer System for On-line Filing of Applications for Protection,
- Computer System of Electronic Document Management LETHOGRAF of AGEPI,
- The e-Governance Project and M-Cloud Platform,
- AGEPI Databases.
As part of the second seminar, the experts of the Industrial Designs Service of OSIM will familiarize the experts of the Trademarks and Industrial Designs Department of AGEPI with the application of legal provisions in cases when an industrial design cannot be protected; legal provisions on refusal of applications for registration of industrial designs; registration of industrial designs being part of class 32 of the Locarno Classification; extent of protection in case of submission for registration of certain words in a special graphical execution; color solution as a essential characteristic of the industrial design; protection as industrial design of a part of the product, including in case when the product photo is presented; registration of complex products; establishment of “informed user” when assessing the individual character of industrial designs.
In the exchange of experience between experts of the two offices will also be addressed aspects of assessing the individual character depending on the degree of author’s freedom in creating the industrial design; exhaustion of rights; opposition proceedings; unregistered design; harmonization of RM legislation with EU legislation; improvement/training of examiners of industrial designs, etc.
The working visit of OSIM experts fits in the agenda of implementation of activities included in the Joint Program of Cooperation between AGEPI and OSIM for 2011-2013 and AGEPI Action Program for 2012.
