From December 1, 2007 enters in force the new warding of the Law on protection of the industrial designs adopted on current July 12 by the Parliament of the Republic of Moldova.
Elaboration of the new warding of this Law was conditioned first of all by the necessity of harmonization of the standards providing protection of the industrial designs with the European Union ones, provided in the Plan of actions RM-UE, approved by the Decree of the Government No. 356 of April 22, 2005, and in the second place by the necessity of liquidation of the discrepancy created between the actual provisions of the law and the nowadays realities.
In the new wording of the law there are specified provisions, related on the object of protection, subjects of the right on the industrial design, procedure of registration and issue of the title of protection, conditions for protection, rights and obligations including the exclusive right on utilization of the industrial design, transfer of rights, rights of the foreign persons, oppositions and disputes solution, fees etc.
The draft of the Law on protection of the industrial designs was elaborated with the help of the EU experts in the frame of the TACIS Project “Consolidation of the legislative base and realization of the industrial property rights’, started in June 2004.
