AGEPI developed a Draft Law Amending and Supplementing the Law on Copyright and Related Rights

AGEPI developed a Draft Law Amending and Supplementing the Law No. 139 of 02.07.2010 on Copyright and Related rights. The Draft aims at effectively implementing the protection principles of copyright and related rights, particularly concerning the terms of protection. This draft is developed for execution of par. 61 of the legislation harmonization Plan for 2015, approved earlier this year by the Government.

Thus, in the Draft are proposed the supplementation of the Law with rules related to the protection of musical compositions created in co-authorship and the possibility of performers to terminate the contracts for transfer of their rights with the producer of phonograms on the expiry of the term of protection; introduction of rules related to the rights of performers and producers of phonograms; the way of printing the performance and cases of legal publication of phonograms. The Draft also contains the proposal for exclusion of the provision on negotiation of single licenses between the Government and holders of computer programs.

In the same context, some editorial amendments are also proposed by the exclusion, addition or concretization of certain notions.

Through these amendments is pursued the uniformization of national legislation with the European and international acts in the field, and consolidation of the existing regulatory framework in the field of copyright and related rights.
