Theoretical and Practical Aspects of the Settlement of Intellectual Property Disputes

On 6 December this year, the State Agency on Intellectual Property (AGEPI) together with the National Institute of Justice (NIJ) organized a Workshop entitled “Theoretical and Practical Aspects of the Settlement of Intellectual Property Disputes”.

The seminar was attended by representatives of Chisinau courts and other courts in the territory, and representatives of the Prosecutor General’s Office, Prosecutor’s Office of TAU Gagauzia, Anticorruption Prosecutor’s Office, Prosecutor’s Office of Chisinau, Prosecutor’s Office of Causeni, Briceni, Anenii Noi districts, etc. At the event were also present specialists from AGEPI and NIJ.

The purpose of the workshop was to increase the powers of judges and prosecutors in the Republic of Moldova in the settlement of intellectual property disputes and to make an exchange of best practices in this area.

The event was opened by Ecaterina Popa, Head of the NIJ Continuous Training Division, who mentioned the fruitful cooperation with AGEPI on promotion of intellectual property among employees in the justice sector of the Republic of Moldova, joint conduct of training seminars, including inclusion in the Annual Judges’ Training Program of a special training course in the field of IP, etc.

AGEPI Director General Octavian Apostol thanked the National Institute of Justice for having contributed to the organization of the Workshop and assured participants of all support from AGEPI specialists in the process of information and consultation on the protection of intellectual property objects, enforcement of IP rights and examination of disputes in this area.

Trainers in the Workshop were AGEPI experts: Rodica Popescu, Head of Legal Assistance and Contracts Registration Division, Simion Levitchi, Head of Trademarks and Industrial Design Department, Patricia Bondaresco, coordinator specialist in the Legal Assistance and Contracts Registration Division, Lilia Vermeiuc, Ad Interim Head of Copyright Department, Victoria Plesca, specialist in the Copyright Department and Andrei Moisei, coordinator specialist in the Training Division.

The event agenda included issues related to the enforcement of intellectual property rights in the Republic of Moldova, in particular practical aspects regarding the protection of trademarks and conflict with other intellectual property rights, the role of right holders in the enforcement of intellectual property rights, issues related to the protection of copyright in the Republic of Moldova and current issues on collective management of economic copyrights and/or related rights: notification, monitoring and supervision of CMO’s. Participants also discussed about the identification of the intellectual property object and determination of the limit of protection.

We should remind that, in April 2013, AGEPI and NIJ signed a memorandum of cooperation by which have pledged to promote information about the national intellectual property protection system among employees in the justice sector of the Republic of Moldova by organizing information and training events for judges, including inviting experts and specialists from abroad.
