In the period 17-18 March 2015, at the AGEPI took place the working visit of the delegation of the Romanian Office for Copyright (ORDA) and the bilateral meetings at AGEPI and ORDA administration level.
ORDA delegation was led by Mr. Leonard Arthur Horvath, Director General, the delegation including Ms Irina Lucan-Arjoca, Deputy Director General, Mr. Razvan Cismoiu, Director of Expertise, Findings, Administration and Organization Directorate, Ms. Anamaria Titu, Director of Registers and Collective Management Directorate, Mr. Cristian Florescu, Head of IT, International Relations and Projects Service.
The purpose of the visit was strengthening relations of cooperation between AGEPI and ORDA and implementation of the Cooperation Protocol between the offices, signed on 16.06.2014.
In accordance with the Program of the working visit, during two days specialists of AGEPI and ORDA discussed issues related to the national system of protection of copyright and related rights in the context of its harmonization with EU directives in the field and monitoring activity of collective management organizations in the field of copyright and related rights. In opening, AGEPI Director General Lilia Bolocan thanked Romanian colleagues for collaboration and accepting the invitation to organize a bilateral meeting, highlighting the importance of such events for the exchange of experience and taking of best practices in the field of protection of copyright and related rights.
In turn, Director General of ORDA, Mr. Leonard Arthur Horvath, welcomed the AGEPI initiative to organize the bilateral meeting, expressing his hope that the discussions will be fruitful and useful to both institutions.
In the bilateral meeting were summarized the achievements recorded by AGEPI and ORDA during 2014 and the copyright management systems in the Republic of Moldova and Romania. Speakers noted both successes achieved, but also problems arising in the work process. In the same vein, it was evaluated the state of cooperation between AGEPI and ORDA based on existing cooperation protocol.
On 17 March, for the purpose of exchanging experience and creating a communication platform in the field of protection of copyright and related rights, it was organized a work table with the participation of ORDA delegation, AGEPI specialists and representatives of collective management organizations of the Republic of Moldova: National Association for the Protection of Intellectual Creation (ANPCI), Association “Copyright and Related Rights” (AsDAC), National Association “Copyright” (ANCO), Republican Copyright Office (ORDA) and Association “ReproMold” (Literary Fund).
In the round table were addressed several aspects of European provisions in the field of copyright and related rights, including the work and management of collective management organizations, collection of royalties and remuneration, relationships between CMOs and users of copyright and related rights, settlement of disputes in the field, etc. In the roundtable, ORDA specialists presented the system of collective management of copyright and related rights in Romania, including the collaboration with organizations and institutions in this field.
On the second day of the bilateral meeting specialists of both offices discussed the implementation of the European Directive on certain permitted uses of orphan works, collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market. They also highlighted the peculiarities of registration of certain categories of objects protected by copyright and related rights, the methods for identifying right holders in case of actions of illegal exploitation of protected objects and the mode of establishing the damage caused to them, and the mechanisms applicable to infringements of copyright and related rights in the internet in order to prevent and combat web piracy.
At the end of the working visit, both sides appreciated the exchange of experience they had and agreed to organize this year another meeting like this.
